Labelixa Acceptable Use Policy

This Acceptable Use Policy ("AUP") describes what is and is not allowed when using the Labelixa service (the "Service") operated by Newempo LLC ("Newempo," "we," "us," or "our"). It supplements the Labelixa Terms of Service. If there is a conflict, the Terms of Service govern, unless a separately signed agreement says otherwise.

1. Scope
This AUP applies to everyone who uses the Service — anonymous users, registered account holders, API users, and paid subscribers. By using the Service, you agree to follow it.
2. General Use Requirements
When using the Service, you must:
- comply with all applicable laws and regulations;
- use the Service only for authorized business or professional purposes;
- keep your account credentials and API keys secure and confidential;
- remain responsible for all activity under your account and API key;
- respect your plan's quotas and rate limits;
- avoid submitting unnecessary sensitive data; and
- have the authority to submit all label and barcode content you provide.
3. Account and API-Key Security
Keep your API keys confidential; do not share, sell, publish, or expose them. You are responsible for all activity under your account and API key, and must not access another user's account, key, systems, or data, or bypass authentication or security controls.
4. Quotas, Rate Limits, and Abuse
Respect the quotas and rate limits that apply to your plan, and do not evade them. Do not create multiple accounts or rotate identifiers to circumvent limits, free-tier restrictions, or access controls. These limits protect the stability of the Service for everyone.
5. Prohibited Content and Conduct
You must not use the Service to, or attempt to:
- gain unauthorized access to accounts, API keys, systems, or data;
- bypass authentication or security controls;
- probe, scan, or perform vulnerability testing without our prior written authorization;
- evade quotas or rate limits, including by creating multiple accounts or rotating identifiers;
- engage in fraud, deception, counterfeiting, or false certification;
- generate labels intended to misrepresent product origin, authenticity, compliance, shipping status, or authorization;
- infringe intellectual-property, privacy, publicity, or other rights;
- distribute malware or harmful code, or conduct denial-of-service or other disruptive automation;
- pursue illegal, sanctioned, or export-restricted uses;
- perform automated scraping or systematic extraction of substantial portions of the Service; or
- reverse engineer the Service, except where applicable law expressly permits it.
6. Fraudulent or Deceptive Labels
Because Labelixa generates labels and barcodes, you must not use it to:
- create counterfeit shipping labels;
- imitate carrier, marketplace, government, certification, or brand labels without authorization;
- create barcodes or labels intended to deceive scanners, systems, customers, or authorities;
- falsely indicate product safety, origin, certification, compliance, or authenticity; or
- bypass shipping fees, customs, taxes, marketplace controls, or inventory controls.
Legitimate testing, sandbox, QA, training, or development use is permitted where it is clearly marked as such and is lawful.
7. Security Testing and Unauthorized Access
Vulnerability testing, scanning, penetration testing, or load testing of the Service requires our prior written authorization. Do not access accounts, API keys, systems, or data without authorization, or defeat security controls.
If you discover a security issue in good faith, send a responsible report to [email protected]. We do not operate a bug-bounty program, and nothing here authorizes destructive testing, unauthorized data access, service disruption, social engineering, or denial-of-service activity.
8. Scraping, Extraction, and Reverse Engineering
Do not scrape, systematically extract, or reproduce substantial portions of the Service. Do not reverse engineer, decompile, or disassemble the Service, except where applicable law expressly permits it notwithstanding this restriction.
9. Integration and Resale
You may integrate Labelixa output and API functionality into your own internal workflows and customer-facing applications, subject to your plan limits — for example, ERP/WMS workflows, shipping integrations, and apps you offer to your own customers. Generated labels and barcodes may be used in your own lawful business operations.
You may not resell access to Labelixa as a standalone competing service, or white-label it as a substitute, without our written authorization. An Enterprise agreement may permit broader integration or resale rights.
10. Sensitive and Regulated Data
Labelixa is intended for ordinary label, barcode, order, product, shipping, and recipient information. Unless expressly agreed in writing with appropriate safeguards in place, you must not submit:
- special-category personal data;
- criminal-conviction data;
- national-identification numbers;
- full payment-card data;
- authentication secrets;
- health data; or
- biometric data.
Avoid placing sensitive data in URL parameters; use request-body methods where the Service supports them. You remain responsible for having a lawful basis for the data you submit and for providing any required notices.
11. Intellectual-Property Rights
The Service and its content are owned by Newempo LLC or its licensors and protected by intellectual-property rights. You retain your rights in the content you submit, subject to the license described in the Terms. You must not use Newempo's or any third party's names, logos, or marks in a misleading or unauthorized way, or otherwise infringe others' rights.
12. Service Integrity and Excessive Load
To protect availability for all users, you must not: send excessive automated requests beyond your plan limits; attempt to degrade availability or performance; conduct denial-of-service activity; misuse anonymous access; or impose an unreasonable load on the Service. Ordinary API automation within your plan limits is permitted.
13. Enforcement
We may investigate suspected violations; limit, suspend, or terminate access, in whole or in part; revoke or rotate API keys; remove or block content or requests where technically applicable; preserve evidence where legally required; and report unlawful conduct to authorities where required or appropriate.
We aim to act proportionately. For a material security, fraud, legal, or operational risk, we may act immediately, including immediate suspension. For a non-urgent, remediable violation, we will give notice and a reasonable opportunity to cure where practical and lawful. Suspension or termination for your violation does not entitle you to a refund beyond what the Billing Policy and mandatory law provide. Your mandatory legal rights remain unaffected.

If you believe someone is misusing the Service, or you have a good-faith security concern, contact [email protected] with enough detail for us to review it.

This AUP supplements the Terms of Service, which control on general legal and commercial matters. An Enterprise agreement may override this AUP where it expressly says so. The Privacy Policy addresses how personal data is processed.
